The ECR4Kids Rewards Program (the “Program”) is offered by ECR4KIDS, L.P., a California limited partnership (the “Company,” “we,” “us,” or “our”) and lets eligible customers earn rewards (“Rewards”) on qualifying purchases made at ecr4kids.com (the “Site”). By creating an account and participating in the Program, you (“you,” “customer”) agree to these Terms & Conditions (these "Terms"), as well as the Terms of Service and Privacy Policy found on our website, which are incorporated by reference.
1. Eligibility
The Program is available only to customers in the United States who have an active account on the Site that is in good standing. Customers that are individuals or the person managing the account on behalf of a business must be at least 18 years of age.
Subject to meeting the applicable eligibility criteria, you will be automatically enrolled in the Program upon creating an account on the Site. Accounts that are already active as of the Effective Date will also be automatically enrolled. If you do not wish to participate in the Program, you must contact support@ecr4kids.com to dis-enroll.
We reserve the right to determine or redetermine eligibility for the Program at any time in our sole discretion. Accounts designated or transitioned by our sales team to formal business-to-business (B2B), wholesale, distributor, or reseller status may not be eligible to earn or redeem Rewards. Any accrued Rewards will be forfeited upon an account’s transition to B2B status.
2. Earning Rewards
Eligible customers earn Rewards equivalent to 5% of the Net Purchase Amount on qualifying merchandise purchased on the Site. “Net Purchase Amount” means the subtotal of eligible merchandise after all discounts have been applied and before taxes and shipping charges are calculated.
Rewards are issued after an order ships.
The following purchases and charges do not earn Rewards:
· Shipping charges
· Taxes
· Gift cards
· Returned or refunded items
· Purchases made through ineligible accounts
· Any other charges or purchases we designate as ineligible
3. Redeeming Rewards
When signed into your account, you may elect to apply your available Rewards balance to a purchase at checkout. If you choose not to apply your Rewards, your balance will remain available for future purchases, subject to the expiration terms below.
Rewards:
· May be redeemed only on eligible purchases at ecr4kids.com;
· May be combined with eligible promotional codes or discounts unless otherwise stated;
· Cannot be redeemed for cash;
· Have no cash value outside of the Program;
· Are non-transferable and may not be sold or exchanged; and
· Cannot be applied to prior purchases
4. Reward Expiration
Rewards expire 180 days after the date they are issued. Expired Rewards cannot be reinstated or redeemed.
5. Returns & Order Adjustments
If an order that earned Rewards is returned, refunded, canceled, or adjusted, the associated Rewards will be deducted from your Rewards balance.
If you use Rewards to pay for a portion of a purchase that is later returned, the portion of the purchase paid with Rewards may, at our discretion, be credited back to your Program account, and the remainder will be refunded to your original payment method.
6. Program Administration and Data Privacy
The Program is administered on our behalf by a third-party service provider. Your participation in the Program requires the collection and sharing of your personal information as described in our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand how we and our service providers collect, use, and share your information. For reference, this third-party provider will be able access data regarding your IP address, geolocation, email address, name, phone number, browser, and operating system.
7. Program Modifications
We reserve the right to modify, suspend, or terminate the Program or these Terms at any time by providing reasonable notice, which may include posting the updated Terms on our Site or sending notice via email to Program members. We also reserve the right to determine eligibility and interpret these Terms at our sole discretion. Continued participation in the Program after such notice constitutes your acceptance of the modified Terms.
8. Fraud, Misuse & Account Termination
Accounts suspected of fraud, abuse of the Program, misuse of Rewards, or violations of these Terms may have Rewards revoked or be removed from the Program at our sole discretion.
9. Governing Law; Dispute Resolution by Binding Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
*Governing Law. The Program and these Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
*Binding Arbitration. You and the Company agree that any and all disputes, claims, or controversies arising out of or relating to the Program or these Terms (collectively, “Disputes”) shall be resolved exclusively through final and binding arbitration, rather than in court. The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules. The arbitration will be conducted in San Diego County, California.
*Class Action Waiver. You and the Company agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general proceeding. Further, unless both you and the company agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
